Where this applies
The wellness caveat applies to every metric, in both tiers, and is
attached in the measurement result as a
disclaimer string on each Advanced (Beta) metric object. Present it wherever
you show a measurement:
- Alongside blood pressure and SpO2 (Advanced / Beta) at all times.
- On any screen that displays measurement results.
- In your app's settings or "about" area.
An attested cloud measurement is not a more authoritative one in the medical sense. Attestation says the number was computed by us rather than asserted by a client; it says nothing about clinical accuracy, and the wellness caveat is unchanged.

Restricted uses
Two limits are not about accuracy but about what the outputs may be used for.
Emotion inference in workplaces and education
Under the EU AI Act, using AI systems that infer a person's emotions in the workplace or in education institutions is a prohibited practice, with narrow medical and safety exemptions. neccessory's optional emotion module — and the attention / engagement output alongside it — must not be used for hiring, employee monitoring, performance evaluation, exam proctoring, or student assessment.
Physical states are outside that definition: heart rate, HRV, breathing rate, stress index, blood pressure, SpO2 and fatigue are not emotion inference. See Metrics for the full split. This is a description of the rule, not legal advice — get your own assessment for your jurisdiction.
Where the frames go depends on the tier
The on-device tier never transmits camera frames. The cloud tier transmits cropped images of the face for server-side processing — they are not stored, but they are processed as biometric personal data, and using that tier requires the consent and documentation described in Cloud privacy.
